My Chapter 7 client is contemplating converting to a Chapter 13 and saving
the house. This seems like a relatively straight forward bit of information
to get, but here is what I am running into: the home lender Bank of
America.
They can not tell me the amount necessary to reinstate the loan. I have
asked for it a half dozen different ways. But I keep getting told things
like "the regular payment is $XXX and the last payment received was in July
2011, so doing the simple math, you get $YYY. Well. That does not help.
There have to be late fees and charges and BofAs junk fees. They keep
sending me a loan history that just tells me that payments have not been
made. I have called back and explained my problem to them yet again and now
I am waiting for a call from the legal department.
How do I ask this in a way to actually get the proper and accurate
information so I can assist my client with making a decision based on real
information? Am I missing something here?
