The court won't issue a discharge until the trustee reports the debtor has cooperated in the case and is entitled to a discharge. Since your client stole from the estate, the trustee won't make that recommendation to the court until the money is paid back to the estate.

Trustee will keep case open to collect note. Once collected, trustee will file a final report and, after the report is approved (could be a year) make a distribution. It will be a long while until the case is closed.

Dear Listmates,
Client (against my advice) spent money from an asset he knew hed be giving to the Trustee. So the trustee gets him to sign a promissory note, on which hes been paying faithfully.
Butthe Ch7 trustee has kept his case open.
Is it because it escaped his attention? Or because he wants to keep the case open until the promissory note is fully paid (April next year)?
I cant find anything on this subject in the Rutter Guide.
