Paying Postpetition Arrearages in Converted 7 to 13 Case-- Is it Possible?

348 includes all postpetition claims. answer is yes. At this years NACBA, one of the lawyers was suggesting that you can file a 13, incur medical bills, even bills you know are coming, and then convert to 7. That really pushes the envelope, but, absent a 523 complaint for incurring debt with no intention to repay said debt, it would work.

yes, but it is harder to get 13's amended when the debtor defaults on the plan. You will have to show a change in circumstances, or some anomaly that caused the default.

At conversion, postpetition claims are included, so go ahead and write a plan including the postpetiton arrears. See 348(d).
