Even after many months of paying much more? I thought that was as of
the inception of the case.

Can you mod the plan down to near zero so she can finish her 20 months, if
she gets a job you could mod it back up, right?

I have attached a Word version of a motion for a hardship discharge I had granted by Judge Brand a couple of years ago. The Debtor wife had her hours cut back to the point that no plan payments were possible. Maybe you can rework it to fit your facts.

Listmates:
I have a client who lost her job and is nearing retirement at age 63.
I've never gone for a hardship discharge. VZ is the judge. Curry is the
Trustee. 20 months left on a 60 month plan.
It's possible that she could get a job but unlikely.
I've looked at cases and postings on the cdcbaa yahoo group on this and
have some samples of motions, but the circumstances were different.
Has anyone successfully been granted a hardship discharge in similar
circumstances? Or if you would just opine as whether you think it's a
worthwhile shot.
