Scenario: Creditor in a Chapter 13 is also a Defendant in adversarial in
same Chapter 13. Adversarial is for violation of Rosenthal, stay
violations, and other such allegations. Debtor called Creditor and said
on
was objected to, I do not know) and Debtor will dismiss adversarial.
Creditor sends representative to hearing as asked by Debtor, and objects.
Court rules that the case converts to Chapter 7 anyway. So now, Creditor
has asked for dismissal of adversarial as promised. Debtor goes silent.
Fortunately, there is still time to respond to adversarial.
Does Creditor go forward with general denial of allegations in adversarial
and include this back in forth with Debtor (fortunately, almost all of it is
on text messaging)? Other suggestions? The whole come to the hearingpromise just smells to me.
I appreciate your thoughts, publicly or privately.
