Today I came across my first bankruptcy hijacking to stop a UD action. Pro Se BK debtor allegedly living in a condo subject to a UD action. Different address than listed on petition. The alleged debtor filed pro per a claim of possession in response to notice of prejudgment right to claim of possession and then filed a demurrer to the UD Complaint. Couple days before hearing files notice of bankruptcy stay even though bk filed two months earlier. Signatures on the UD documents look nothing like those on bk petition. Tenants of property all claim they do not know the debtor when asked.
Landlord's UD attorney apoplectic over concept that automatic stay can be asserted by someone who nobody on either side of the litigation knows, ever heard of prior to claiming to be a tenant in possession, or has ever seen since entering into the UD case.
Looks like 3 other UD cases similarly affected.
