tax refunds under Chapter 13

I had case with Nancy Zamora and she allowed me to claim $250.00 per month
in income as projected anticipated tax refund because of the fact that this
was not money paid into the IRS, but it was the child care tax credit or
something like that. So because this was not money being paid in and
refunded, she allowed it as long as I claimed it as projected income in I.
With that I was able to avoid the refund going into plan.

If it is for past years refunds, debtor needs to prepare them and
file with the IRS and then you have the correct refund amount to
exempt. If you are talking about future years, no debtor cannot
exempt the asset because it does not exist at the time of the petition
being filed.
