Chapter 13 Proof of Claim for Secured Creditors with Arrears
It has been a long week and my mind is drawing a blank on whether a proof of claim is required for a trust deed holder to be paid by the Chapter 13 Trustee for arrears through the Chapter 13 plan if the plan itself calls for the secured trust deed holder's arrears to be paid through the plan?
If the creditor fails to file a claim, the debtor may always file under section 501(c) a claim for the lender after the claims bar date expires. What is the binding effect of a debtor filed proof of claim on the creditor? (The Debtor is rarley sure of the exact amount of arrears owed.)
