Here's a new one:
I filed a Chapter 7 case for a debtor. She owns no real estate and
has no joint accounts with anyone.
I just got an angry call from the debtor that Bank of America (with
whom Debtor has NO accounts) has stopped accepting her parents'
mortgage payments and are "monitoring" their account because the
debtor filed bankruptcy (yes, they acknowledge that the account
holders did not file bankruptcy). I have no idea what's going on
or what to do about it because they aren't violating the stay and
haven't done anything untoward to my client.
Anyone heard of this happening or what I can advise debtor's parents
to do?

That sounds like a violation of the automatic stay to me even though it's
indirect. I wonder if it's an FDCPA violation, too.

The debtors had accounts at Chase as did their mother. The debtor was a
pay on death beneficiary for the mother and they found out about the bk and
created a lot of problems for the mother. Eventually, everything got
resolved and they are accepting the mother's payments at the bank now.

How did they even know those were her parents--you state she has no bank accounts with Bank of America; does she have a credit card with B of A and they are on it? I refuse to believe they actually have live people over at B of A that personally check bankruptcies and cross check to see if their families have mortgages with B of A. In connection with Probate or Conservatorships, my dealing with B of A staff leads me to suspect they cannot walk and chew gum at the same time.
