Late last year I filed a motion to refinance. Trustee and I
stipulated to increase percentage to unsecured creditors, pay
refinance moneys & 2002-03 tax refunds to Trustee and Trustee would
recommend discharge. Debtor in error failed to pay approximately
$400. Case was dismissed due to a $400 deficiency (keep in mind that
overall Debtor has paid over $80K). Now I filed a motion to reopen
the case. Trustee is no longer happy with the entered stipulation and
wants debtor to increase percentage by paying 2004 refund (if there is
one) to Trustee if not Trustee may recommend that the Court not reopen
case. I have a hearing mid June. What can be done to ensure that
client receives discharge without paying more?
