Based on the question you ask, you need a better understanding of CA marital
property law and how it affects and is affected by bankruptcy. I was on a
panel last year for one of our CLEs which covered these issues. You should
read the materials carefully (which should be in the yahoo database) to
begin to get the necessary foundation to be able to represent married
clients in bankruptcy. Once you get that foundation, you will be able to
formulate more focused questions that will address your clients' issues and
save you from malpracticing.

I have a PC who is filing alone, spouse has no debt, except for a car they are both financing. They want to surrender the vehicle. I remember reading that if the couple live together, the filing by one spouse will protect the non filing spouse from the community debt. Am I right, or am I remembering this wrong.
