Power of Attorney
If spouse is leaving the country it makes a difference whether they are buying or selling. A Financial power of attorney might accomplish what they want if it specifically states that it applies to property transaction for house located at >>>> You could list property for sale with a FPOA, and probably accept an offer with it, but I would think you need signatures beyond that. The documents for a purchase or sale can be fed exed anywhere, spouse can sign, have notarized and return. A buyer who is trying to use a FPOA presents a different problem. When I was a real estate broker I would be hesitant about dealing with the spouse buying property who claimed that the other spouse was out of the country and could not even be reached. Company executives travel and the spouses do pick out houses without them, but you can get signatures. I did have a title company executive call me once when I had a difficult to reach seller, and they wanted lots of information, and did contact the missing spouse.
