Hi all,
Potential chapter 13 client who is divorced, agreed to pay a marital
property settlement equalization payment in the amt of $80k in exchange for
keeping his business.
1. Can he get a 1328 discharge of the equalization payment if the payment
is not considered a "domestic support obligation?" and
2. If the settlement agreement is silent as to whether the equalization
payment is in the nature of support, do you think that the chapter 13
debtor would be likely to win if challenged?
