Yes. There are two circuit court decisions that are in disagreement: In
re Baud (6th Circuit) and In re Tennyson (11th Circuit).
I just got the email from the 9th Circuit requesting a response. Here we

Thanks for the update, Nancy. Plans that last less than five years force debtors to have extra money each month after plan completion. That makes for a harrowing future, full of the temptations of avarice. The petition was undoubtedly filed with the goal of protecting debtors from the curse of mammon arising from that excess lucre.

Dear Listmates:
Rod Danielson has petition for rehearing en banc on the Flores matter.
We are waiting to hear from the 9th Circuit Court whether they want us
to file an answer. The trustee also mentioned in bk court on Monday that
if the 9th Circuit rejects their petition for en banc rehearing, they
are considering petitioning for writ of certiorari. I will keep you
posted.

Dear Listmates,
I was at a 341 hearing today in which Kathy Dockery's staff attorney, Lucy, said that since my client's annualized CMI was above the median he had to have a five-year plan. I pointed out that my client's DMI was very negative, so he could be in the proposed three-year plan based on the very recent holding in Danielson v. Flores. She was unfamiliar with the case and asked me to email it to her - which I just did. Obviously, Flores will do the trick.
I am telling you this to report that we are already seeing a dividend from Nancy Clark's hard work in the Flores case. Once again, brava, Nancy!
