Client in new Chapter 13 has equity and wants/needs to sell house. Sale should have enough to pay off all the unsecured debts, and that's the plan. Likely it will all be accomplished before the confirmation hearing, and maybe dismiss then, but client needs to get there.
Is there any requirement of anyone's approval or notice of listing the property for sale?
Just tell the Trustee at the 341(a)? (VZ and NC case).
Will a broker take a listing from a Chapter 13 debtor?
I see LBR 3015-1 and form 3015-1.15 provide for approval of sale, once it is in escrow, but we're not there yet.
Experiences please? (and case numbers of NC case where you did it?)
