Does Homestead exemption apply in HOA foreclosure of assessment lien?
Dear Listserve;
Does the California homestead exemption apply in a Homeowners Association
foreclosure on an assessment lien?. Is the lien considered voluntary and
therefore the homestead laws will not apply?
If the homestead exemption applies, is it carved out of the top of the
proceeds on the foreclosure sale or when the HOA sells the property
subsequently. What is the homestead exemption priority?
