Please keep in mind that PACA trust fund claims take priority over the
Trustee and will get paid before a Trustee and administrative claims as
PACA funds are not property of the Estate.
Steve- If you need further information please call me directly. I have had
a couple of PACA cases.

Nick;
That statute starts out with an exception for the Perishable Agricultural Commodities Act and the Packers and Stockyard Act. I think the former
may act may apply because he deals in perishable vegetables. So while I hope Section 525 applies, I am not familiar with that possible exception of the Perishable Agricultural Commodities Act. The only case Ive dealt with that may be aware of the special
provisions, the business was dead already.

Colleagues:
Potential client is a produce wholesaler with a $900,000 judgment
against him for a personal guarantee on a lease of a former business.
He is concerned about losing his licenses if he files bankruptcy. I've
backed on to one of these USDA regulated industries before and realized
how little I knew. He wants to keep the business ongoing and he is a
sole proprietorship.
Has anyone ever filed such a business before that can share with me how
they fared on the license issue? Do I need to incorporate his business
before filing?
