Recent Published BAP Decision on the Absolute Priority

Wow...that's quite a dissent by Judge Jury. Her point about an
objection to plan confirmation being different than a vote against
the plan is an important one.
Since BK courts aren't bound by BAP decisions, sounds like this is
still an open matter, particularly in Judge Jury's court.
Since there were apparently no active appellees in this matter, I'm
assuming there's no way this gets appealed to the 9th circuit right?
