Thank you. However, the best thing to do it make sure your clients
don't have funds with WF. Second, if this happens you can usually get
the Trustee to sign a release stating they do not oppose the exemption
and WF will release the funds. In my case the Trustee was out on
vacation and the client could not wait. He needed the cash to feed his
family.

I filed a Motion for Violation of the Stay recently citing the
Mwangi case. Judge Russell granted it. I also asked for legal fees and
sanctions. The judge continued the hearing on the fees to allow WF a
chance to respond since my initial Motion was heard on short notice. WF
has not responded yet. I am filing a supplemental declaration in
support of sanctions. Debtors received an eviction notice, lost their
deposit and incurred several late and NSF charges due to WF's violation.

Stay Work?
The BAP for the 9th has held that Wells violates the stay by
freezing accounts. Has anyone challenged Wells subsequent to the BAP
ruling?
