Hello,
I have two questions.
First
Is there a way for me to send notice electronically to more people
(specifically creditors)? I find that I spend a lot of time sending notice.
Is there a form I can file with the court? - if someone has a first day
motion they file that helps with this, I'd really appreciate a case number.
Second
Post-petition, pre-confirmation, my co-worker's client began to make
"adequate protection payments." Nothing was stipulated to, and the creditor
claims it didn't even ask or want those payments because it wants to lift
the stay.
Here is the issue. My co-worker wants me to find case law that says
something like, "those creditors who accept adequate protection payments
should not be allowed to file a motion to lift the stay." If anyone knows of
a case or can give me a lead I'd highly appreciate it.
