Is the emotional illness such that medications cannot help the debtor live an economically viable life?
If the debtor is deemed to be permanently disabled by the Social Security Administration then as of july 2013 he or she will be in a better position to qualify for a hardship discharge through DOE as opposed to going through the bankruptcy system.
