The Chase letter clearly states that the lien will be reconveyed; the Bank of America letter doesnt, but I called a rep at B of A who said that yes, the liens would be reconveyed. All of our clients received the letter before filing bankruptcy; and in fact the forgiveness of the second TD caused one client to decide not to file because of concerns that the equity with the second forgiven exceeded the homestead exemption.

Have seen quite a few.
The issue is, they are 'forgiving' the loan, but we have not explicitly seen them saying they are releasing the lien on title.
I have a client in a 13 who got the 'we are forgiving the loan' letter, but at the same time I got a letter at the office offering a stip essentially with the Lam terms 'if the 13 completes'. Why would that matter if the forgiveness is real?
I know we all love and trust the banks, but cya.

Have any of you seen Bank of America issue the reconveyance letters in chapter 7 cases? I have only had clients receive them in chapter 13 cases.
