I received a phone call at 2:30pm completely out of the blue for an emergency Chapter 13 filing with a sale at 3pm. I would have to say yes or no on the phone knowing nothing. My gut reaction was one of those clients that never gives you anything you need until it is really last minute (annoying), or a scam. I like to sit down and meet my clients and talk to them prior to accepting representation. There are just too many weird things going on out there.
But am I being overly cautious?

2 weeks is my bare minimum. Always has been and will be for the
foreseeable future. There simply isn't enough time to properly
prepare a petition and anticipate all the relevant issues in less
time, and as Margaret Norman aptly observed, these clients are
almost never worth it anyway. True, I turn away a lot of money
every year because of this policy, but it's the only way I can do
the job I feel I need to do for the client while keeping what's left
of my sanity.

I've taken "emergency" chapter 13 clients with as little as a couple days before a sale date so long as they understood that they would need to show up at the sale with proof of filing. I can't imagine any scenario where 30 minutes would be enough time to prepare and file a case and stop a sale.
There is such thing as a client holding out hope of a sale extension until the last minute and the "emergency" clients I've taken have been no different from other clients. Plus, it can be nice to get a quick paycheck and finish the filing in an afternoon. Anybody that waits until the last day (or the last 30 minutes) is another story - in which I agree with all the other comments on not taking the case.

When I dream about my ideal client, "emergency" is a word far from my
mind. I refer people like this on to others who are willing to drop
their well-planned days to chase something that may or may not pan out.
While we all love to offer help to people in bad situations, some people
just can't seem to help themselves enough to warrant our efforts.
Waiting until the last half-hour of a process that probably started a
year or more ago to find their bankruptcy lawyer is their problem, not
yours.

We have a slogan we put up during the holidays "Your emergency is not necessarily our emergency!" Experience tells you that anybody who waits until 2:30 to call an attorney regarding a sale at 3PM will be the client from hell. They will show up with no paperwork, not enough money and regard any loss of the house as a problem which you created. So it is a scam in a way, as they are looking for somebody to blame.
