The only provision in the bankruptcy code that makes the automatic stay terminate, of which I am aware, is section 362(c)(3) which is only triggered if there had been a case dismissed within a year of filing the currently pending case. That section does not apply on this client's facts because
1. The only dismissal was in 2011--more than 1 year before latest filing in 2013. 2. The only case that ended in 2012, i.e. within 1 year of filing the currently pending case, ended with a discharge.
