You cannot anticipate when you will give advice to an assisted person. An
assisted person is anyone who's debts are mostly consumer. That is most
Californian whose nonmortgage debts do not exceed their mortgages.
The second part of the test is a person who has less than $175,750 of
nonexempt property. Anyone with an upside down home, and no large pension,
will likely be an assisted person.
I hear people tell me all the time that they don't represent assisted
persons, but the first 11 you file for someone with an upside down house
will be the one that bites you in the rear.
528 says you give all of the fees back if you don't comply and the debtor
complains.
Even my card contains the 528(b)(2)(B) language:
"We are a debt relief agency. We help people file for bankruptcy relief
under the bankruptcy code."
528 is less than a page long.
