Hello all -
I had a disclosure statement hearing in front of Judge Riblet yesterday
morning (extending into afternoon.). She commented onthe Absolute
Priority Rule, but gave no indication which way she was heading. Told
us to look at Friedman and Maharaj, and to give it our best shot when it
was time to confirm.
As another piece of news, I know I talked to someone on this listserv
about getting paid in my case. I am scheduling myself for $1,500monthly
payments for several years until my fees are paid. Someone suggested
that I include a provision in the disclosure statement that I will
record the fee order as a way of ensuring that I get paid. Riblet said
no, I've never seen that in 25 years on the bench, can't do it, can't
make myself secured without a good reason.
