Estate representative wants to file for bankruptcy protection

Or you could Email Patrick Green since he does both bankruptcy and probate. It is possible to enjoin a foreclosure through the probate court but since the sale is in such a short time I don't know if there is enough time.

The estate is not a person and cannot file for bankruptcy protection, but
the Executor may be able to enjoin the sale in probate court. Does the
executor have a probate attorney?

Conservatorships" by Patrick Green and Mark Jessee, who put on a very good
program about this two to four cdcbaa meetings ago. Their program

Be careful if you are filing for bankruptcy whether the living trust is the
debtor. Only business trusts are allowed to be debtors.

The filing of a bankruptcy for anyone who has an interest in the property
would stop the foreclosure sale, but I suggest contacting a probate/trusts
attorney.
I recently saw a state court filing that stopped a sale on these exact
facts.

I just received a call from the Personal Representative (Executor) of the
Estate of a deceased individual. Now in probate and title has not passed. He
wants to eventially sell the subject real property, but it facing a trustee
foreclosure sale later this week.
He wants to file to stop the foreclosure proceedings.
I am thinking that an estate is not an individual or any of the other categories
of eligible debtors.
Not sure how to proceed.
