My understanding is that some judges allow this (where there was a
CH. 7 case, discharge entered, and then a Chapter 13 is filed to
strip the wholly unsecured junior lien). In that instance, who gets
paid from the monthly plan payment (whatever that plan payment may
be)? Does the debtor need to pay all the discharged creditors from
their CH. 7? Only the creditor whose lien is being stripped? Or
must there be new unsecured debt to pay?
Also, does anyone have a list of which judges are currently allowing
this? I know Judge Tighe is allowing it now. Who else?
