Dennis, the William D. Ford Program is an absolute joke and a mess. Servicers don't understand all the options available to borrowers, nor do they explain the options they do understand. It's one of the major reasons why I've been focusing so heavily on student loan work for consumers.
Federal student loans don't need dischargeability - the existing regulations work exceptionally well for those who negotiate the waters. Private loans, on the other hand - those should be treated the same way as any other unsecured, nonpriority consumer debt.

Today we got DOE to accept payments of $283 per month for 9 months to rehab the loan. At the end of the 9 months, they will remove approximately $45,000 in fees and penalties They will also make the changes to the client's credit report that show that he is in good standing. In addition, garnishment and tax offset will be removed - they are both stayed during the rehab period.
After the 9 months, the client will owe approximately $213,000.00.
We will be able to get the client into an income-dependent repayment plan of about $220 per month for 25 years. At the end of the 25 year period, the remaining balance of the loans will be forgiven permanently.

We have been advising people to use the Ford program for years. The bad
part is, as the client gets older, and starts making more money, the gov't
will take a larger payment. I really do not understand these programs that
have a disincentive for doing well later in life. This new 25 year program
doesn't look that different. The client is in jail for 25 years. We need
to go back to dischargeable student loans.
