I believe you back out the child support on line 40 of the (Ch 13) means test, or at least "to the extent reasonably necessary to be expended for such child."
(Sorry for the late response- I wasn't receiving listserv emails last week and suddenly got a week's worth today.)_______________________________________

Hi Karen, I might be reading this wrong, but I don only back it out if youre paying it, not if youre receiving it under the Necessary tab. I dont think its backed out on the income tab. Although I wonder, is she actually receiving that income or is it merely ordered? Thatahoogroups.com [mailto:cdcbaa@yahoogroups.com]

Subject: [cdcbaa] Child support puts debtor in Ch 13; but, no funds for repayment plan Dear List: Person considering bankruptcy receives $10,000 / month child support. Her earned income is around $1000.00 / month. $11,000 / month income would tentatively put her into a Chapter 13 scenario. Because the child support can be backed out on the Ch 13 means test (and is not fair game for funding a repayment plan), is is possible to file her under Chapter 7?k you. _______________________________________ Karen Ware THE LAW OFFICES OF KAREN WARE, PC Attorney Phone: (805) 284-0760 ext. 803 Phone: (818) 284-4537 ext. 803 FAX: (805) 284-0760 kware@karenwarelaw.com www.karenwarelaw.com Woodland Hills 5850 Canoga Avenue
