Hi Tuan,
I have brief from Simon Resnik that proposes to bifurcate the student loans and unsecured. Although the brief is asking the opposite of what you want to do, I think it will provide a good framework for your brief. I would brief it because Curry will object to the plan with those provisions and you will need to respond to the objection. It is better to be over prepared!
However, I only found my physical copy and it does not have the exhibits. Instead of scanning it with all the coffee stains on it, I will give you the case number, 2:13-bk-30884-SK [Docket 22]. I hope it helps!

e, Thanks for the response. Mine is before Nancy Curry. I would be willing to share my brief but I have never done one on this issue before. Did we need to brief this issue or can we just write the provision into the courts Chapter 13 plan form? Thanks. Subject: [cdcbaa] Chap 13 Student Loans Dear List,
I have a client that owns a home and left with not many options but to file for Chapter 13. The property has a lot of unexempt equity resulting in a 100% plan.uding the student loans entirely from the plan payment and have it paid outside of the plan per the original contract terms. Is it possible to have a plan approved with type of provision?
Thanks,
Tuan Le
