Hi Hale,
Thank you for your input. I did read Wells Fargo and I do warn my clients about them.
However, they are not pretending this is for the trustee or estate. They are admittedly attempting to hold the funds until they can get relief from stay.
I also warn my clients about unpredictable behavior by credit unions, but I was surprised by this move.
I think my best argument is that he was not in default at the time they froze it and the ipso fact clause is not valid. Thus, the elements giving rise to the right to set off are not present. Yet, I am still researching.
