I don't see any reason you can't cover as much of the award with the personal injury exemption, then use as much of the wild card on the remainder as possible. - John D. Faucher818/889-8080

Dear List,
I haven't dealt with many personal injury cases in conjunction with a bankruptcy. I have a potential client that is looking at a potential settlement that would net her over the allowed amount under the wild card exemption. My question is could the debtor claim both the wild card and the Personal Injury exemption under 703.140(b)(11)(D) to exempt the settlement award?
Thanks in advance.
