This is what I do - others may do differently- submit app to employ special counsel to BK court because if they are going to pay the state court attorney they have to find the money and debtor is supposedly committing all disposable income to the plan. Then when state court attorney is going to be paid submit fee app - you will probably need to prepare for them. Same thing as when you have a CPA that is going to work with the debtor to do more than tax returns. App to employ professional. You help them prepare the fee app when they are going to be paid.

If a debtor in a confirmed ch 13 bankruptcy wants to hire a lawyer to litigate in state court against the debtor's lender, how does the lawyer get hired/paid? is an application to employ required? can lawyer collect fees directly from debtor? or does lawyer have to constantly apply for fees from the ch 13 trustee?
