Just some quick thoughts for you Steve. I don't have enough facts to make a determination, but my first thought is why is this not quasi community property? I would also be curious why he transferred it to the wife and whether he intended to transmutate the property to her separate property.

They are going to NC tomorrow anyway and will bring all the deeds they have on the property from the inception of the ownership to present.

NC is not a community property state. Both spouses live here when not in NC and plan to stay here once their home in NC is foreclosed upon next month. I need to refer them to a family law attorney to make the determination as to whether this is community property that needs to be reported in husbands case if I file the husband only. They are going to NC tomorrow anyway and will bring all the deeds they have on the property from the inception of the ownership to present. So this is both a conflicts of law and a family law matter as I presently see it. Can anyone refer me to a practitioner up to making the determination as to whether the raw land is community property? Steve

I have a PC who lives here and until recently in N. Carolina, is
married, and transferred raw land in NC to his wife more than 2 years
ago.
NC is not a community property state.
Both spouses live here when not in NC and plan to stay here once their
home in NC is foreclosed upon next month.
I need to refer them to a family law attorney to make the determination
as to whether this is community property that needs to be reported in
husband's case if I file the husband only. They are going to NC
tomorrow anyway and will bring all the deeds they have on the property
from the inception of the ownership to present.
So this is both a conflicts of law and a family law matter as I
presently see it.
Can anyone refer me to a practitioner up to making the determination as
to whether the raw land is community property?
