Chase is refusing to modify the debtor's loan under the national mortgage
settlement and set the sale date for tomorrow so we filed a chapter 13. We
want to "force" them to comply with the settlement but I am not sure how I
can accomplish this. We know what the monthly mortgage payment should be
under the settlement and so we want to propose that number and start paying
that starting June and then file *some kind of* adversary against Chase.
I am not sure whether this will fly at all. Is there any way to suspend
mortgage payments in the beginning of the Chapter 13 pending the outcome of
an adversary re the loan modification? Curry/Zurzolo.
Any guidance is appreciated.
