Ventura County Sheriff's office is taking the position that if a levy was issued pre-bk and even if it did not receive the funds from the bank upon which it levied, once the bk is finished, the funds have to be released to it despite the discharge and despite the exemption of the funds. They are making file a motion to avoid the lien. The local rule form is not applicable. Has anyone filed one recently? If so, please give me the case number.
