Judge Clarkson opinion on Trustee Real Estate Carveouts

I believe that good judges sometimes like to tell us the arguments we SHOULD
be making, instead of the ones we actually do. In this case, does it appear
to anyone else that The Honorable Scott Clarkson is looking for someone to
raise the argument in footnote 1, regarding whether it is bad faith for the
lenders, in concert with the Chapter 7 Trustee, to provide a gratuity to
the estate, so that the lender does not have to proceed with foreclosure and
to undertake the necessary requirements in state law?
