Members: I have received a number of such notices on my confirmed
bankruptcy cases where anywhere between $75.00 per month to a new greedy
little record of $220.00 per month for "Property Preservation" Expenses in
a case where debtor's plan to pay back arrears has been confirmed and they
are in fact occupying the property.
Of course the concern is that What kind of property preservation expense
requires a $220 monthly fee? Who did what to incur such a fee? And it is
a repeated abuse if in fact nothing reasonable and necessary is required
under the circumstances to perform such service. AND I also notice a
monthly attorney fee of $100.50 per month fee being added, along with tax
advances that are are supposedly non-escrowed when the debtor is paying an
escrow impound each month.
Anyone have a sample objection to one of these things? Is anyone pursuing
some sort of a blanket "this is messed up Nationstar" sort of action
against Nationstar or other banks engaging in this sort of conduct?
