Hi Pat,
I actually don't think the inheritance matters, I guess I eagerly pressed sent to Larry's answer without putting down all the facts that debtor inherited the property but maintains it while living there, i.e. pays for the expenses even property taxes.

Hi Larry,
You are correct but I did verify the 50/50 division. Is there any evidence the trustee will need to see to verify the division other than a grant deed showing joint tenancy?
