Yes, Section 8 housing assistance is considered income under the means test. I know. Shortly after the law change I failed to disclose it under the means test and got my hand slapped after an audit. Public assistance on the other hand is not, according to the U.S. Trustee but I never understood the distinction. Not sure about WIC or CAL FRESH. I disclose them on schedule I just so OUST is on notice if they want to challenge the means test.

I am filing a chapter 7 bankruptcy for a client that is currently receiving Section 8 housing to pay for her rent (she is the renter not the landlord). I wanted to know if anyone has had a client receiving Section 8 benefits before? Would her Section 8 benefits be affected or stop because of the bankruptcy and would she be required to report the bankruptcy to her Section 8 case worker? Any information would be appreciated.
