OK,then there shouldn't be a breach of contract issue/claim on those facts and the property would belong to the estate.

I have a PC that was duped into a real estate contract to sell their property for below market value. They're looking to file BK on this and for all their credit card debt. I did a little research and it looks like a property sales contract may not be considered executory that can be rejected? Is that correct? Could someone provide some insight? Thanks.
