Do I need to record the Abandonment Order?

Holly:
The question is when. If the debtor will be refinancing before the case is closed, the order will have to be recorded.
In the ordinary course, lots of debtors refinance after their case is closed, but there are little or no title issues after the case is closed. So, if the debtor will be refinancing or selling before the case is closed, you will have to record.
In fact, in this situation (escrow closing before the case closes) I ask the title officer if the title co has a particular form of order, which they prefer. If they have one, I use it. The title co will record it and insure title.
