So I have an issue where I have a chapter 13 confirmed plan. Only the wife is the debtor. The married copy file joint tax returns. The couple incurred joint tax liability in 2012 and filed a joint return.e husband and that the IRS can collect from him outside of bankruptcy.
The IRS Special Procedures also intends to file an adminstrative claim for the 2012 IRS taxes. Nonetheless, they state they can record a lien and levy on Hubby's bank account and garnish wages.
Is this correct in chapter 13?
Is the remedy to file a motion to impose a stay on the non-debtor using Section 105 and amend to plan to accomodate the taxes?
Its Friday and my head is hurting.
