In this case, argued by Nancy Clark on behalf of the Debtors, the 9th
Cir Court of Appeals upholds the part of Kagenveama which states that an
above median debtor with negative DMI does not have to file a 5-year
plan.
Rod Danielson's office argued that because the Supreme Court in Lanning
overruled Kagenveama the debtors must file a 5 year plan. The 9th
Circuit Disagreed.
Needless to say, this is a victory for debtors in general and we are
very proud of Nancy for the work she put into this successful result.
