APR in Individual Ch 11
I have an individual Chapter 11 in front of Judge Brand. She told me in
court last week that this would be the first individual case she would be
confirming that has an APR issue. Thus, it would seem to be a case that
would set the tone for which way she would lean. She would like me to
brief this thoroughly. If anyone has a brief already written or would like
to send me cases or legal theories in support of debtor's position that NO
APR should exist in individual cases, it would be much appreciated. I
would like to have any input before end of Sept.
