Which is, of course, a double-edged sword. When it comes to secured
consumer debts that reduction in interest rates will cause a reamortization
- lower payments means less of a deduction on the means test.

Keep in mind that under the Servicemembers Civil Relief Act (SCRA),
creditors, including a pension plan, are required to drop interest rates
down to no more than 6 percent on debt owed by those called up to military
service for the period of such military service.

Thanks, but i think if we start trying to ascribe fairness and
reason to the purpose and rationales of the means test we will be
spinning our so-called wheels in perpetuity.

I think the distinction is that reservist and national guard members on
active duty have civilian jobs that they leave when called up. Those
civilian jobs may pay very well, which could cause the presumption to arise
in situations where they are currently (or were recently ) taking a
financial beating while on active duty. While on active duty, I assume they
are paid as poorly as the guys and gals in harm's way in Afghanistan and
other outposts.

Under the National Guard and Reservists Relief Debt Act of 2008, members of
the National Guard or Armed Forces Reserve are temporarily excluded from
the means test for entire time you are on active duty and 540 days
thereafter, provided you serve at least 90 days. If your duty is less than
90 days, you do not qualify. If you are simply active military duty, you do
not qualify.

Is it correct that active military members overseas are still
subject to the means test, but National Guard or Reservists are
not? I never really looked at this before, but that seems very odd.
