Hello, these are some questions I have. I am not sure whether they fall
under "litigating with HOAs" but I thought I'd throw them out there.
1. Should we be reading CC&Rs for holes or are they sufficiently uniform
that we generally cannot strip HOA liens.
2. Does the HOA lien take priority over all other liens? An example would
be property is valued at 300k, Bank lien is 200k, exemption is 75k,
judicial lien is 25k, HOA records a 30k lien. Even though HOA lien was
recorded after judicial lien, if it has higher priority then judicial lien
can be stripped. So what's the order of priority there?
3. I thought I read a case last year where the HOA obtained a money
judgment and recorded it. The recordation of the abstract of judgment made
the HOA's lien "merge" into the abstract and so it became subject to a lien
strip. Does the panel have any comments as to that? I can't find the case.
