Current percentage for compensation of Chapter 13 Trustees

Hale: Before you are finished your fee app, you know how long it took to prepare it. As a result, I ask for compensation for present app and generally get it. What is often not awarded is the time to appear at the fee app, cause you cannot know that charge until the day you make the appearance.
I have estimated the time for the hearing and had it denied, but not the prep of the app.

I am specifically referring to 11 U.S.C. 330(a)(4)(B). The code section is
designed to allow for a Chapter 13 Debtor to pay for things such as a
divorce attorney which may not benefit the Estate and might actually hurt
the Estate.
Can an individual in a Chapter 11 hire an attorney to commence dissolution
proceedings where those services are not reasonably likely to benefit the
estate and they are not necessary to the administration of the case? You
file the employment app and the Judge authorizes it. If a creditor were to
object, what would the outcome be?
In general, Section (a)(4)(B) is an exception to (a)(4)(A). Professionals
may be hired and paid by the estate for services which do not benefit the
estate and are not necessary to the administration of the case.

Hi Hale. I have never filed a Chapter 13 case but since Chapter 13 attorneys are allowed to be paid for things that Chapter 11 attorneys are not allowed to be paid for, I would think the Court would be more lenient with Chapter 13 debtor attorneys. You should estimate fees for preparing the final fee app including time at the hearing and present it to the Court. I would present it as a cost saving measure to save the debtor and the estate money but that you would be happy to file a subsequent fee application if that way would please the Court.If you prefer a nonconfrontational means of achieving a similar result, you can calculate your loss and make up for it. Say on average you lose $750 for that final fee app and it takes you, on average, 25 hours to complete a Chapter 13 case. Then 750/25 $30 per hour you've lost. If you increase your hourly rate by $30, you will recoup your fees.

Contrast this trustee's 10% + 1% + .1% + .01% + .001% etc with attorneys'
internal payments for work done to get payments: fee apps.
Attorneys are allowed to bill for time required to complete fee apps, but
not allowed to bill for work not yet done. This means (as the bench has
instructed me), that we can charge for every fee app except the present one,
since work on it is not completed at time of filing it. Thus, unless we do
fee apps to continue to get paid for completing fee apps, means in cases
where there is only one fee app, we don't get paid to do fee apps.

That is correct, she gets paid for paying herself, and also paid for paying
herself for paying herself and so on. That's why it's 11.111111...%
In other words: 10% + 1% + .1% + .01% + .001% etc.
A typical calculation is as follows: suppose plan payments equal $60,000.
The Trustee will keep 10% for herself. So it's 54k paid to creditors 6k
paid to herself.
6k is 10% of 60k.
6k is 11.1% of 54k.
