Stay Violation?

Call the issuer, fax a letter to the bankruptcy department. If they bill
again, you've got a party and they're going to be the ones paying the bar
tab.

Stay Violation?

Hi Desiree:
Send them a Notice of Automatic Stay, EZ Filing has it under the Supplemental Forms. Mail to them so they have double notice. You may want to send it certified, but Kohl's is usually compliant. They must just have a mix up in their billing dept.
However, if it continues then you have a stay violation. Probably no attorney fees until you can set up a pattern that they are ignoring in many cases.

My clients, who are in an open Chapter 7, just sent me a billing statement from Kohls, complete with a payment coupon listing the Balance Due and Total Payment Now Due with a Due Date. Kohls is properly listed on Schedule F. Buried in the 2nd page is a statement that this is not an attempt to collect and provided for information only.
Any thoughts on whether this is a stay violation?
